The founding fathers included impeachment in the constitution so that Congress would have a way to remove leaders who had "rendered themselves obnoxious," in the words of Benjamin Franklin. But the way they set up the process, it's nearly impossible to remove a president from office without substantial support from the president's own party. That's what happened during Watergate: some congressional republicans protected Richard Nixon, but others demanded to know the extent of his involvement in a break-in at the headquarters of the Democratic National Committee, and the subsequent cover-up. In the words of then-Senator Howard Baker, a Republican from Tennessee, "What did the President know, and when did he know it?" It was pressure from Republican leaders like Barry Goldwater that made Nixon resign before the House could vote on articles of impeachment-- Goldwater convinced Nixon that too many Republicans were willing to vote to remove him from office, he'd never survive a Senate vote. The opposite was true during the impeachment proceedings for Bill Clinton. After it became clear he lied during a deposition for a sexual assault suit brought by a former employee, Paula Jones, about his relationship with a different employee, Monica Lewinsky, Republicans in Congress argued the offense was serious enough to be impeachable. Democrats disagreed, and although the House voted to impeach Clinton on a party-line vote, not a single Democratic senator voted to remove him from office. If a President still has the support of a majority of his political party, history suggests the chances for impeaching and removing him from office are slim to none. While legal scholars, activists, and some Democratic members of Congress have pushed for articles of impeachment against Donald Trump, it seems unlikely at this point that a substantial number of Republicans would break rank in the Senate to create a 2/3 majority in favor of removal from office. The American Revolution (HIST 116) Professor Freeman discusses the national debate over the proposed Constitution, arguing that in many ways, when Americans debated its ratification, they were debating the consequences and meaning of the Revolution. Some feared that a stronger, more centralized government would trample on the rights and liberties that had been won through warfare, pushing the new nation back into tyranny, monarchy, or aristocracy. The Federalist essays represented one particularly ambitious attempt to quash Anti-Federalist criticism of the Constitution. Checkpoints are weighed carefully by courts, attempting to balance drivers' 4th amendment rights with law enforcement's duty to protect the public. Officers are trained to engage drivers in a casual manner. By greeting people informally they try to lower concerns about traffic stops. Random vehicle stops violate the 4th amendment, so why are dui checkpoints constitutional? The US Supreme Court has ruled that in very specific and defined circumstances checkpoints can be used to target a limited number of crimes. When evaluating police practices, courts must balance citizen's rights against the legitimate interests of police to uphold the law. Many believe that police are slowly chipping away at their rights and that courts are refusing to address the problem. Unfortunately, this officer does not know the law. The officer does not need probable cause to execute a checkpoint stop. During a traffic stop an officer is not legally required to show his identification. Matt Wallin explains the relevant laws in detail. What happens if you forgot your license at home and the police ask for it? The officer is allowed to conduct a warrantless search of the vehicle to find it! Matt explains how far police are allowed to go to verify your identity. Intimidation and bullying is a common tactic used by law enforcement. By infringing on your freedom of movement, police put pressure on drivers to comply with their orders.

Hobbes and Locke were both influential in the development of social contract theory. In Leviathan, Thomas Hobbes advances the idea of a permanent social contract in which people give up sovereignty to a governing authority in order to avoid the state of nature, which is a state of war with "every man against every man." After the Glorious Revolution, John Locke responded with his Two Treatises of Government, in which he argued that people enter into a social contract and form a government in order to preserve their natural rights (life, liberty, and property). In Locke's social contract, the people retain sovereignty and reserve the right to alter or abolish the social contract if the government fails to protect their natural rights. I spend the first part of the lecture providing a summary of Hobbes' Leviathan, followed by a summary of Locke, then I use a graphic organizer to compare and contrast Hobbes' and Locke's social contract philosophies, noting key similarities and differences between the two theorists. Mastodon's Leviathan album is brought in from time to time just because it's awesome. This lecture is designed specifically for AP European History students studying Absolutism and Constitutionalism in preparation for their exam, but can also serve students in other disciplines, such as US History and Government, as well. Two weeks ago at the last City Council meeting I asked a very important question to the council. The question was this, "does the City Council have the power to overturn unconstitutional laws that may be presented." The answer was yes. Now while the council has established verbally it's authority to do so I will now present to the council it's obligation of follow-through regarding this manner in spite of Mr. Van Nests assurance of the yard parking ordinance being Constitutional. Before I tackle that issue though, I want it to be precorsed by this, the motive uncovering all this is not to create an us versus them mentality, between the governing and governed. Albeit some of the things spoken here may be abrasive and give that perception. Last Monday we celebrated Martin Luther King day and it's in the words he wrote which reflect the expression of why were here today. He said in regards to the injustices he sought to be wrought in his day: Actually we who engage in nonviolent direct action are not the creators of tension. We merely bring to the surface the hidden tension that is already alive. We bring it out to the open where it can be seen and dealt with. Like a boil that can never be cured as long as it covered up but must be opened with all its puss flowing ugliness to the natural medicines of air and light, injustice must also likewise be exposed, with all of the tension it's exposing creates, to the light of human conscience in the air of national opinion before it can be cured. Dr. Martin Luther King also noted in his writings that the legality of the law does not reflect its morality and in our case it's constitutionality. In honor of Dr. King today I would humbly ask that you would be long suffering in hearing and know my sincerest intentions are for everyone in this room and my persistence for principles. In the zoning in comprehensive plan used by Batavia on the second page under the heading of early challenges to zoning, it states the following " common-law has long recognize that certain uses of properties, were or could be so undesirable that neighboring landowners in the community as a whole have the right to request their termination thus arose the theory of nuisance. It seems to me, and correct me if I'm wrong that the premise of which this law rests on is the idea or theory that it is a public nuisance. So with that being said lets defined what a public nuisance is. According to Cornell university of law A Public Nuisance is an activity or thing that affects the health, safety, or morals of a community. It is distinguished from a private nuisance, which harms only a neighbor or a few individuals. For example, a factory that spews out clouds of noxious fumes is a public nuisance, but playing drums at three in the morning is a private nuisance bothering only the immediate neighbors. Further solidifying this is the definition used in the zoning in comprehensive plan: The validity of the laws constitutionality must be substantially related to public health safety morals or general welfare. Now with the information that has been presented in conjunction with it's clear obstruction that I have outline before of my Fifth Amendment right, that is that private property shall not be taken for public use without just compensation. This law of a yard parking ordinance can anyone on the council expressed to me here and now how this law protects public health safety morals or the general welfare of the public. More specifically I would ask who's rights are being violated by anyone in the city by parking on their own property? James Madison one said “Knowledge will forever govern ignorance, and a people who mean to be their own governors, must arm themselves with the power knowledge gives.” This is our intention and we believe the counsels too, therefore In closing I would ask the Council for a true judiciary review of this law and many others that are innocently criminalizing the citizens of the city because this isn't the only one... Under chapter 3 of the city charter subsection 3-8 this would be possible by calling a special counsel meeting. Its first three words – “We The People” – affirm that the government of the United States exists to serve its citizens. The supremacy of the people through their elected representatives is recognized in Article I, which creates a Congress consisting of a Senate and a House of Representatives. The positioning of Congress at the beginning of the Constitution affirms its status as the “First Branch” of the federal government. The Constitution assigned to Congress responsibility for organizing the executive and judicial branches, raising revenue, declaring war, and making all laws necessary for executing these powers. The dialogue hosted 120 community leaders involved in the reconciliation of specific injustices, government officials, decision-makers from major institutions and members of the public. More information: www.sfu.ca/reconciling-injustices. About Judge Maryka Omatsu Maryka Omatsu, a third generation Japanese Canadian, was born in Hamilton, Ontario. She graduated with a M.A. from the U. of T. and an LL.B. from Osgoode Hall Law School. During the following 37 years, Maryka has been a lawyer for 16 years, practised human rights, environmental and criminal law; worked for all levels of Government; taught in Toronto, China and Japan; chaired the Ontario Human Rights Appeals Tribunal and adjudicated for the Ontario Law Society. 21 years ago, Maryka was the first woman of East Asian ancestry to be appointed a judge in Canada. Today, she is semi-retired, judges part time in Toronto, and lives in both Vancouver and Toronto. Maryka was active in the Japanese Canadian community's struggle for redress, as a member of the National Association of Japanese Canadians negotiation team. Her book, Bittersweet Passage documented that history and won several prizes. It was published in Japan in 1994.

VOA news for Thursday, March 17th, 2016 From Washington this is VOA news. I'm Victor Beattie reporting. Kurdish officials in northeast Syria are expected to declare a federal system in areas they control. The announcement could come as early as Thursday following a conference in Kurdish held territory. U.S. spokesman Mark Toner Wednesday said such a move must be widely accepted by Syria's various factions. “and in response to that I would just say we've been very clear that we won't recognize any kind self-rule semi-autonomous zones in Syria and really this is something that needs to be discussed and agreed upon by the relevant parties in Geneva but then more broadly accepted by the Syrian people themselves.” The plan's been rejected by Damascus, the Kurds currently are excluded from the Geneva peace process on Syria’s political future. The move will also likely face opposition from neighboring Turkey which fears a Kurdish state would increase calls for separatism among its own minority Kurds. In Nigeria, two suicide bombers killed at least twenty two people at a mosque outside the Borno state capital, Maiduguri, Wednesday. The attack wounded nearly twenty others and took place in a village and is the first such assault since early February, there was no immediate claim of responsibility. Although similar attacks carried out by the Sunni insurgency Boko Haram which has pledged its allegiance to the Islamic state. Kenya's armed forces on Wednesday killed at least nineteen suspected al Shabab fighters attempting to ambush Somali troops in southern Somalia. The Kenyan troops are acting under the aegis of the African Union mission to Somalia AMISOM. The firefight occurred in the lower Juba area follows a string of militant attacks including a twin bombing in Baidoa last month that killed at least thirty people. This is VOA news. The White House says President Obama will deliver an address to the Cuban people on Tuesday at the end of a historic visit next week to the communist ruled island nation. Officials say it will lay out a vision of greater freedom and economic opportunity. Ted Hanken, a Cuban analyst Abreu college New York says the White House hopes to change the view of the Cuban people toward the U.S. “Communicate directly to the people that policies are built around, environment, prosperity, not poverty, engagement, not isolation and while we were all making diplomatic connections and strides with the government, we also intend to continue to respectfully and diplomatically but forcefully stand up for American values of human rights and democracy.” Mr Obama's trip, which begins Sunday, will be the first by a sitting U.S. President in nearly ninety years. Embattled Brazilian President Dilma Rousseff Wednesday named her popular predecessor, Luiz Inacio Lula da Silva, as her chief of staff, a move that offers him protection from prosecution over corruption allegations. Mark Jones is a Latin American analyst at Rice University. “By naming him her chief of staff he receives ministerial immunity, which means he can only be tried by the Supreme Court and given the ways, that means little be potentially running for president in a couple of years when that actually might be even occur.” Ms. Rousseff herself faces a series of allegations, her image has been tarnished by a deepening recession and impeachment proceedings. President Obama, Wednesday, nominated Federal Appeals Court Judge Merrick Garland to fill the Supreme Court seat vacated last month, following the sudden death of Justice Antonin Scalia. “Selected nominee who is widely recognized not only as one of America's sharpest legal minds, but someone who brings to his work a spirit of decency , modesty, Integrity, even handedness, and excellenence.” But Republican Senate Majority Leader Mitch McConnell said the Senate will not take up the matter since Mr Obama's in the final months of his last term. “It is a President's constitutional right to nominate a Supreme Court Justice. And it is the Senate's constitutional right act to act as a check on a President and withhold its consent.” He said the nomination should be left to the next Patesident to fill. The European Union holds a two day summit Thursday on finalizing an agreement with Turkey to curb mass migration to Europe. The deal obligates Ankara to halt the perilous sea journeys of migrants refugees, take back illegal immigrants from Greece. For each one Turkey takes in, another will be sent to the twenty eight member EU. The Islamists administration in Libya's capital Tripoli has warned a new U.N.-backed unity government Wednesday that it’s not welcome. When law enforcement conducts a custodial interrogation, they are required to recite basic constitutional rights to the individual, known as Miranda rights, and secure a waiver of those rights before proceeding. The waiver must be voluntarily, knowingly, and intelligently made. Miranda waivers by juveniles present distinct issues. Recent advances in cognitive science research have shown that the capacity of youth to grasp legal rights is less than that of an adult. This is especially true for very young, developmentally disabled, or cognitively delayed children, and for those with mental health problems.

Parenting Plans, Parenting Time Schedules, Custody Agreements

The Importance of Parenting Plans In cases where children are involved, the final agreement regarding custody (now referred to as “legal decision-making”) and parenting time is memorialized in a document known as a PARENTING PLAN. This document is typically attached to the final order such as a consent decree of dissolution of marriage, an order of paternity or an order modifying legal decision-making and/or parenting time. However, if the parents reach an agreement regarding legal decision-making and parenting time prior to agreeing on all issues, the parenting plan can be adopted as a temporary order or even a final order of the court before the remaining issues are resolved. Parents who are able to reach agreements regarding terms of their parenting plans may feel it is not necessary to spell out precisely and in detail their regular parenting-time schedule, holiday or vacation schedules, or how they will make certain decisions for their children. They may feel they will “always get along” and be able to agree how to parent their children. As long as these parents continue to communicate with each other regarding their children and come to agreements, they may be able to get by without a detailed parenting plan. When disputes arise, however, the parenting plan is the governing document that determines how decisions are made for the children and where the children spend their time. The parenting plan is the constitution of parenting for a family that is no longer intact. Because the parenting plan governs legal decision-making authority and parenting time, it is important to have a well-drafted and extremely thorough document. If any provisions of the parenting plan are vague or ambiguous, it is an invitation for future bickering and potential litigation. Even if the parents are amicable and on good terms at the time the parenting plan is drafted, they should be as specific and detailed as possible in order to avoid future disagreements. One purpose of the parenting plan is to designate legal decision-making rights – whether the parents share joint legal decision-making or whether one parent is granted sole legal decision-making. The parenting plan also indicates each parent’s rights and responsibilities for the personal care of the child or children and may detail how decisions regarding the children’s education, health care and religious training will be made when the parents are unable to agree on their own. The parenting plan also sets forth the parenting time schedule for the children, including holidays and vacations. It is extremely important to define with specificity the start and end times for the parents’ regular parenting time, vacation and holiday parenting time to avoid any confusion or disagreement. The parenting plan should also include a procedure for the exchange of the children, including the location for the exchanges and the responsibility for transportation. Finally, a procedure for communicating with each other about the children, including methods and frequency, should be included in the parenting plan. If desired, a method of communicating with children can also be included, such as allowing telephonic or “face time” access for a parent during times the children are residing with the other parent. It is extremely important to be precise and detailed when drafting a parenting plan. If details are not included and times or dates are left “to be determined”, the parents may end up back in court when disputes arise. Parents may believe they would never argue about holidays or exchange times of their children, but people change. Lives evolve and grow. New spouses become involved, and what worked previously may no longer work. A parenting plan is a critical document in any case involving minor children. It is the document referred to most often, and if drafted properly and thoroughly, it should settle many disputes and squabbles. Parents should engage experienced family law attorneys to assist in drafting comprehensive parenting plans that will help the parents minimize future litigation regarding their children.
