The Family Medical Leave Act FMLA
FMLA administration can be very complicated. Not only must your employee meet certain qualifications to be eligible, but there are processes to be followed as well. KPA’s Kathryn Carlson will explain the intricacies of FMLA and how it interacts with COBRA, ADA, and more. This webinar will cover: When are employees eligible? Employer responsibilities Overlapping state and federal laws Consolidated Omnibus Budget Reconciliation Act (COBRA) The relationship and overlap between COBRA and FMLA What is the FMLA exactly? The Family Medical Leave Act was passed in 1993. Out of all of the federal employment laws, FMLA is one of the most popular and beneficial to employees. It's been proven over the past 11 to 12 years that it isn't imposing an undue hardship in employers, but certainly employers need to be very cognizant of their rights and responsibilities. A very popular question is can I fire somebody who's on FMLA? Or somebody goes on leave and we recognize that we don't want them back, how do we handle it? It's important that the training around FMLA is not just senior management and the human resources department. Because supervisors deal directly with the employee, it's critical that supervisors have at least a basic understanding. Who is covered by the Family Medical Leave Act? Private and public employers, not just government entities, but any private employer that employees 50 or more employees for each working day, during each of 20 or more calendar work weeks in the proceeding or current calendar year. That's a lot of math. If you feel like doing it, so that you can say, I actually only have 49 employees for 19 of the days. You can figure out how to avoid it. As a rule of thumb, most employers say if I have 50 or more employees of the majority of the year, I'm covered. It also extends in a 75 mile radius. By that I mean if you have 2 or more locations under common ownership, whether they're owned by an individual or a corporate entity and they're within a 75 mile radius, they're employees are combined. If you have 35 employees at one location and 20 miles down the road, you had 40 employees, both groups, if they're with common ownership of the two dealerships would be covered by the FMLA. Common ownership is typically defined as one entity. Again, that could be an individual. It can be corporation. It can be a limited partnership. But something that's recognized as a business entity that owns 51% or more of the location. The requirements, we're going to go through these in quite a bit of detail, but the basic requirements of the FMLA are that an employer must reinstate the employee to the same or equivalent position upon conclusion of the FMLA. An equivalent does not mean that you bring them in at the same salary, but reduce their duty. It needs to be equivalent. You can't demote somebody, but keep paying them, which is bad economic policy and practice anyway. It doesn't have to be the exact same position. So if during the 12 week leave that the individual requested, you move another individual into the position and they are doing fine and you want to do a reorganization. When the person comes back, bring them into an equivalent position. The same or equivalent job duties, same and equivalent salary. You must also continue health benefits at the same level as prior to the start of the FMLA. Other benefits are governed by company policy. Whether you allow people to continue to accrue vacation, or sick leave, or paid holidays, anything that is not specific to healthcare coverage, you can define by policy. Start, because you're going to hear this about 12 times during the webinar today, but here's your first one. It's very important that you document your own FLMA policy and have it separate from your leave policy. One of the conundrums I see, sometimes, employers try put them together, and they can be in your same section of your handbook, the policies can be right next to each other, but they try to meld it all together. That becomes a very confusing to the employee. You may have your own leave policies related to paid time off, vacation pay, sick pay, you may even offer unpaid leave. If you're big enough to qualify for FMLA, FMLA becomes your unpaid leave. If you're too small for FMLA, unpaid leave is a policy that's a tough economic decision for most employers. You want to be sure that you have a documented policy, so there's total clarity, in what you're going to do during FMLA leave. It also, your policy, will clarify what the employee needs to do, how do they request the leave, how is the leave granted, what's required for doctor certification, how do they return to work. Those are all things that the policy will clarify. The good news is, because I always like to give out a little bonus for the webinars that I conduct, is we'll be sending you a sample FMLA policy as part of your information that Rebecca sends out later today.

Remarks of President Barack Obama Weekly Address The White House April 26, 2014 Hi, everybody. In my State of the Union Address, I talked about pizza. More specifically, I talked about a pizza chain in Minneapolis -- Punch Pizza -- whose owner, John Soranno, made the business decision to give his employees a raise to ten bucks an hour. A couple weeks ago, I got a letter from a small business owner who watched that night. Yasmin Ibrahim is an immigrant who owns her own restaurant -- Desi Shack -- and plans to open another this summer. Here's what she wrote. "I was moved by John Soranno's story. It got me thinking about my ... full-time employees and their ability to survive on $8 an hour in New York City." So a few weeks ago, Yasmin put in place a plan to lift wages for her employees at both her restaurants to at least $10 an hour by the end of this year. But here's the thing -- Yasmin isn't just raising her employees' wages because it's the right thing to do. She's doing it for the same reason John Soranno did. It makes good business sense. Yasmin wrote, "It will allow us to attract and retain better talent -- improving customer experience, reducing employee churn and training costs. We believe doing so makes good business sense while at the same time having a positive impact on the community." Yasmin's right. That's why, two months ago, I issued an Executive Order requiring workers on new federal contracts to be paid a fair wage of at least ten dollars and ten cents an hour. But in order to make a difference for every American, Congress needs to do something. And America knows it. Right now, there's a bill that would boost America's minimum wage to ten dollars and ten cents an hour. That would lift wages for nearly 28 million Americans across the country. 28 million. And we're not just talking about young people on their first job. The average minimum wage worker is 35 years old. They work hard, often in physically demanding jobs. And while not all of us always see eye to eye politically, one thing we overwhelmingly agree on is that nobody who works full-time should ever have to live in poverty. That's why nearly three in four Americans support raising the minimum wage. The problem is, Republicans in Congress don't support raising the minimum wage. Some even want to get rid of it entirely. In Oklahoma, for example, the Republican governor just signed a law prohibiting cities from establishing their own minimum wage. That's why this fight is so important. That's why people like John and Yasmin are giving their workers a raise. That's why several states, counties, and cities are going around Congress to raise their workers' wages. That's why I'll keep up this fight. Because we know that our economy works best when it works for all of us -- not just a fortunate few. We believe we do better when everyone who works hard has a chance to get ahead. That's what opportunity is all about. And if you agree with us, we could use your help. Republicans have voted more than 50 times to undermine or repeal health care for millions of Americans. They should vote at least once to raise the minimum wage for millions of working families. If a Republican in Congress represents you, tell him or her it's time to give the politics a rest for a while and do something to help working Americans. It's time for "ten-ten." Governor Christie on CNBCs Squawk Box Part 2 March 17, 2010 (transcript below) HOST: Governor, across the country the rise in red ink is in state pension plans. How big is your problem, and how do you take that on? GOVERNOR CHRISTIE: Our problem is about a $46 billion dollar problem right now. Here's what you have to do, and what I've suggested that we have to do. You have to bend the cost curve on these pensions, and so what we need, over the last three, we have had retirees health benefit costs go, or pension benefit cost, go up 56%. 56%! Obviously our benefits are too rich and we don't have the employee's paying into the pension system. They pay a set amount. They don't have it fluctuate, like most private pensions do, based on the performance of the market and everything else. So, yes, we have to bend that curve back on benefits. HOST: And you go back to any people that already have this and going anything, you can't. GOVERNOR CHRISTIE: Well, you can on future benefits, anything they vested in you can't. But on future benefits you can, but if you make some of those changes that we've talked you will bring that curve. For instance, if we brought down the cost of COLAS that are getting into pensions we could cut the $46 billion in half, to $23 billion. Like that. So you can make changes on the benefits side that will help and the state has to start contributing again to the pension which we haven't done before. But, the fact is even if completely contributed to the pension everything we were supposed to it would be funded at 74%, right now it is funded at %64. So, what you can tell is that's a 10% difference if we made ever contribute we're supposed to over the last decade. We've got to get the benefits side to. HOST: No one will ever get a defined plan for state employees from here on out, will they? GOVERNOR CHRISTIE: Well no, there still is a defined plan. For unionized workers. HOST: And you can't take on those entrenched... GOVERNOR CHRISTIE: Oh, well I am taking them on. HOST: Can you succeed? (They have contracts right now) GOVERNOR CHRISTIE: Sure. The contracts will be up in June of 2011. So, keep an eye on that. And we have layoffs coming in January of 2011. Now Governor Corzine tided my hands, and said I couldn't any layoffs, made a deal with them to prevent me from doing any layoffs until January of 2011. We'll do some layoffs then, and then will get ready to bargain with them, a new bargaining. We have to look at the way pensions are dealt with because for non-unionized it's over, there's no more defined benefit plan it's a defined contribution plan. HOST: If Health Care becomes federal law, would you push for a state constitutional amendment that will allow New Jersey to opt out the way some states are moving? GOVERNOR CHRISTIE: I concerned what the plan looks like in Washington, I really am. I got to see how it will affect New Jersey specifically. You know this plan seems, I was listen in the green room of your last interview, this baby is a moving target. They're making deals left, right, all over the place to try to get this thing done. I don't even know what it's going to look for anymore. So, I don't want to pre-judge it Carl, I don't think it's fair to pre-judge it. Let's see what the plan turns out to be, if it passes , I am not convinced it will pass yet. But if it passes, let's see what it is, how it affects New Jersey, and what ways I can maneuver our state to make sure we don't get hurt by it. So... HOST: ...It's already been deemed passed, I'm sorry. So, Clearly you weren't listening. GOVERNOR CHRISTIE: Listen, all I heard was somebody trying to desperately bail out water in that last segment, I mean that was a lot of bailing of water going on from Virginia. HOST: Let me ask you about the state of New Jersey right now just in terms of the emergency weather. Still thousands of people without power, myself included, this has been going on since then. Where do things stand right now and what's going to happen just in terms of the state of emergency. GOVERNOR CHRISTIE: Bergen county was the hardest hit in terms of the loss of power. We've been moving it in the right direction. About 2/3 of the people who loss power, have power back. I'm told by the utility companies that by Thursday we should have everybody back online. But it's been an awful time. In the eight weeks I've been here we've had two nor'easters, a flood, and two blizzards. I've declared state's of emergencies four times in eight weeks. I'm waiting for the four horsemen of the Apocalypse to come. I mean this has just, not been a great, that and cutting $13 billion. Who wanted this job in the first place? We're getting there Becky, I am going to go tour the areas of Passaic county this afternoon where there has been enormous flooding going on and I think by Thursday I told by our board of public utilities we should...

AFGE General Counsel David Borer Appears on WUSA 9 News to Discuss Sequestration
AFGE General Counsel David Borer recently appeared on WUSA Channel 9 Local News in Washington, DC to discuss sequestration and the threat of furloughs and how it will impact federal employees. http://www.wusa9.com/news/local/story.aspx?storyid=245424 Article text: WASHINGTON (WUSA9) -- The federal government is required to give employees 30 days notice before a furlough can take affect. Those notices are expected to come this Friday, March 1st, which means furloughs could begin in April, and federals workers will have to cut their own personal budgets as best they can. "I'm very upset... It's going to affect my pocketbook, I'm concerned, says Linda Vincent, a paralegal specialist for the Department of Health and Human Services. She and her co-workers in NW D.C. are worried about looming furloughs that appear to be rolling forward as part of Sequestration to kick in on March 1st. Which means furloughs could start on April 1st. HHS employee Francis Rucio said she has one-year-old twins and is very concerned about the hit on her paycheck. Workers haven't been told yet how many days pay they would lose, but it could add up to as much as 20 percent of their salaries. Rucio says the first place she'd cut would be from her children's college 529 savings plan. Then, maybe from her retirement funds. "I don't have a lot of discretionary spending." David Borer The General Counsel for AFGE, the American Federation of Government Employees, says federal workers have suffered enough, after three years of a pay freeze. "It's needs to stop. They need to stop treating federal employees like an ATM. And they need to deal with the tax loopholes and the other kind of changes that are going to balance the budget," said Borer. Borer says while the DOW Jones and private sector are doing fine, it's working people, private and federal, who are hurting and will be hurt more when the cuts come. "Typically, a government worker makes between $50 to 70,000 a year. And if you subtract 5, 6, $10,000 out of that due to a furlough, that's real money. That's money that won't be re-spent in the community by these workers and it's going to have a ripple effect through the local economy," said Borer. "Everybody's going to be hurt. Yes, we're worried," said Ernestine Barksdale who works in the Chicken and Waffles Food Truck parked near Union Station. She said most of their customers are federal workers. Some federal workers say forced furloughs imply that their work is not valued and their pay not important. And that makes them angry. "We're just like everybody else, whether in private industry or the federal government. We need our paychecks. We all work real hard. To be told we're going to be cut one day a week, that's going to hurt, especially the lower grades and I feel bad about that," said Linda Vincent. The union AFGE says the average federal worker in this area makes around $60,000 annually. AFGE is trying to lesson the hardship by asking agencies to allow employee to chose their furlough days, and also allow those who can afford furloughs to take more on, voluntarily, allowing co-workers who cannot afford them, to keep working. Sort of a furlough swap to help out a more needy co-worker.
