As I discuss in this video, bi-polar disorder is an overused diagnosis, often given by family doctors who do not have specialized training in mental illness. Social Security disability judges see references to bipolar disorder frequently and they are less likely to approve claims that do not contain evidence of a severe degree of impairment. However you can still win if your file contains the right kind of documentation. More specifically, judges expect to see extensive treatment records covering a long period of time from both psychiatrists and psychologists. Depression is one of the leading causes of disability world wide. Disability claims based on depression are routinely challenged by insurance companies, Social Security Administration and The Department of Veterans Affairs. If this has been your experience, it may be time to seek legal help in order to prove you are indeed disabled. Depression is not a sign of personal weakness, it is a real mental illness with real causes. The cause may be due to Chemistry, Biology, life experiences, disorders of the brain caused by chemical imbalance, genetics, emotional/physical trauma or a hormone imbalance. Depression can also co exist with a painful medical condition or as a reaction to the condition. There are different forms of depression disorders including major depression, dysthymic disorder, minor depression and bipolar disorder. Symptoms of depression and the severity of each symptom will vary between persons. Depression is an illness that affects the whole person. People who suffer from depression have trouble concentrating, sleeping or eating and have lost interest in taking care of their daily activities. They may also exhibit- avoidance of people, refound grief, and a lack of energy. SSD & Depression: To win SSD for depression you need to prove one thing: That your depression is sever enough to stop you from working. To determine a persons eligibility for benefits the SSA adheres to their Listings of Impairments. The Listing for depression is found under Mental Disorders. If your condition is sever enough to satisfy these requirements, you'll be considered disabled by the SSA. The SSA will need medical evidence to support your exact limitations. This means that they will wanna see medical records and psychiatric records from doctors psychiatrists, physiologists, mental health clinics or other health facilities where you received treatment. VA & Depression: Depression disordered are often endured by Veterans would have lived through the emotional stress of War, the death or injury of fellow soldiers and comrades, living through unbearable conditions or struggling with their own physical injuries or disorders. Veterans Disability benefits are based on the establishment of a service connected impairment. Disability ratings are assigned based on the severity of the impairment or combination of impairments. To arrive at a rating the VA relies on the VA schedule for rating disabilities. Depression is listed under Mental Disorders and further identified as a mood disorder. VA disability payments are then awarded based on this assessment. Depressive disorders may begin because of experiences or injuries the Veteran had while in service. Traumatic brain injury is frequently responsible for the onset of depression. Depressive illness may be closely related to other service connected disorders, such as PTSD. LTD & Depression: You may also be able to clam disability benefits through your LTD insurance for your depression. Whether you have LTD insurance privately or through your employer, it's the insurance carrier who will process the claim. It has become routine practice for many insurance companies to deny legitimate claims for depression or to devalue these claims. Insurance claims for depression disability present their own unique set of challenges- like insurers stating that the disability is not sever enough to qualify for disability. Symptoms of depression are emotional and abstract, sometimes with highs and lows which makes it difficult to measure its severity. This then allows for insurers to claim you do not meet their definition of disability. Most insurance companies have a clause that states mental disorders as mental nervous for which the benefit pay period is limited to only two years. In their attempt to reduce payment periods your insurer may try to award benefits only for depression under the mental nervous condition clause with no separate recognition of the physical disability. Most Social Security disability claimants will be directed to see a Social Security medical doctor or psychologist for a consultative examination at some point during their SSDI or SSI case. As I discuss in this video, most consultative evaluations with medical doctors are often a waste of time as SSA uses industrial clinic doctors who otherwise help workers compensation insurance companies deny claims. Psychologists on the consultative panels, however, are more likely to produce reasonable reports. Consultative evaluation reports have taken on more importance with SSA’s new policies that remove controlling weight from opinions by long time treating physicians. Are you at risk of surveillance by Social Security when you file a claim for disability benefits, or after you are approved? There are certainly some members of Congress who believe that SSDI and SSI are rife with fraud and they would investigate every claim if they could. Continuing Disability Reviews: a Threat to Your SSDI Benefits?

Social Security conducts "continuing disability reviews" (called CDRs) of approved disability claimants and is increasingly using this process to cut off benefits. Most favorable decisions contain a paragraph where the judge classifies an approved claim as one that should be reviewed in three, five or seven years. Generally, five and seven year review cases are ones where the judge feels that medical improvement is not likely. Three year reviews (or even one year reviews) are cases where the judge believes that with medical care (arising from Medicare or Medicaid) you are likely to improve and regain the capacity to work. Whatever the type of review noted in your decision you should prepare for a possible CDR down the road. I advise my clients to: - continue treating with their physicians - keep their own medical record files - identify individuals who might be able to testify on their behalf in a CDR hearing Because there are no past due benefits in a continuing review case, you will not be able to retain a lawyer to represent you in a CDR hearing under a "no fee unless you win" contingency fee contract. Most disability claimants will not have the funds to hire a lawyer to appear with them at hearings. Social Security knows this means that claimants appearing in a CDR hearing are likely to be unrepresented and thus less likely to win CDR hearings. Success at a CDR hearing will go to the organized and the prepared. Do not become complacent and assume that your benefits will necessarily continue for the rest of your life. Prepare for Trick Questions from the Social Security Judge

Testifying at your Social Security disability hearing is not the same as having a conversation with your neighbor or even talking to your doctor. When your judge asks you questions about your medical condition, he will be listening for two purposes: (1) he wants to a better understanding of how your medical issues impact your day to day life; and (2) he will use your testimony to make a decision about your credibility. Social Security judges understand that your written medical record does not tell the whole story about your capacity to function in a job. After all, most doctors are primarily focused on treating you, not evaluating your work capacity. Further, some doctors minimize symptoms in their notes to paint a picture of successful treatment, or because they do not believe in the concept of disability. Whatever his conclusions about medical records, the judge wants to hear from you. But he is not going to accept your testimony as truthful if he believes that you are prone to exaggeration or that you are more focused on collecting benefits than fighting to return to work. Often you can expect your judge to ask you questions to which he already knows the answer. In this video, I describe a recent hearing where the judge asked my client about his cigarette smoking habit. The judge asked these questions for the express purpose of evaluating my client's credibility, and by answering inaccurately, my client definitely damaged his case. Your attorney can really earn his money by helping your practice answering likely hearing questions. Stress caused by a reprimand from your boss, chatter from co-workers, or complaints from an unhappy customer can overwhelm you to the point where you lose the capacity to get through a workday. If you are extremely sensitive to stress to the level where your anxiety level leaves you non-functional, you may have a viable and legitimate claim for Social Security disability benefits. As I discuss in this video, anxiety cases in Social Security disability claims can be difficult because there are no objective tests like an MRI or CT scan that allows your doctor to “see” your anxiety. But long term treatment records and support from your doctor in the form of a functional capacity evaluation or a statement that you meet Listing 12.06 can be enough to convince a judge to award benefits. If you are suffering with severe anxiety disorder, you know how difficult it can be to function normally in your day-to-day life. When you add the pressures of work - meeting deadlines, interacting with co-workers, supervisors, the general public, getting through 8 hours a day regularly - anxiety disorder can shut you down. Social Security disability focuses on the impact of your anxiety disorder on work functioning. In this video I speak about the two arguments I use to win when representing clients with anxiety issues, PTSD and associated mental health conditions. In many cases I use both arguments. The Listing argument arises from Listing 12.06 and, in my experience, generally requires that we have evidence of in-patient psychiatric hospitalizations, suicide attempts, and long standing, but unsuccessful treatment. In addition to the Listing argument, I also will set forth a functional capacity theory of disability, using non-medical evidence such as statements from former co-workers or supervisors to document that my client would not be reliable at any type of job.
